Important Announcement
Physician Owned PT Practice Update

Both SCAPTA and the Attorney General’s Office in SC have successfully petitioned to intervene in the pending lawsuit. Both parties support the position of the defendant to uphold the recent SC AG ruling on the interpretation of S.C. Code Ann. Section 40-45-110(A). In the motion to intervene the SC Attorney General’s Office made the following statements: “In our opinion, Section 40-45-110(A) was enacted by the General Assembly for the purpose of preventing conflicts of interest by prohibiting physical therapists from accepting referrals from physicians who employ them. See, Op. S.C. Atty. Gen., March 30, 2004. Thus, the Board of Physical Therapy Examiners should be allowed to proceed to discipline physical therapists who violate the statute.”

To allow more time for all parties in the lawsuit to prepare, the court date has been pushed back and is currently scheduled for August 30. It is SCAPTA’s understanding although the PT Board of Examiners can not take disciplinary action against therapists until a judgment has been reached, the Board is able to begin to accept complaints and to investigate those complaints at the end of the 90 day grace period that ends July 8. We will seek clarification from the Board on their position and plans and post these shortly.
